Distracted Driving Scholarship

Official Rules 

Encharter Insurance LLC (“Encharter”) is seeking original videos 1-5 minutes in length that exemplify distracted driving and mention “Encharter Insurance”.  The video can not show anything illegal or dangerous, including a person operating a vehicle while distracted.  Instead, submitted videos are to creatively demonstrate or explain the concept of distracted driving without the actual operation of a vehicle.

Eligibility:

 

  • This opportunity is open to all United States citizens who are at least seventeen years of age and are either currently enrolled in a U.S. Department of Education accredited 2-year or 4-year college or university, or are high school seniors who plan to attend a 2-year or 4-year U.S. Department of Education accredited college or university in the fall semester following submission of their entry.

 

  • Applicants are welcome to submit more than one entry.

Submission Method:

All video submissions must be e-mailed to socialnetworks@encharter.com.  Submissions by mail will not be accepted.  All entries must be accompanied by a completed Official Entry Form, which is available on Encharter’s web site at www.encharter.com.  Any entries that do not include a completed Official Entry Form will be disqualified.

Scholarship Award:

 

  • The winner will be awarded one $2,000 scholarship. 

Award money is to be used solely as tuition for the winner's own college education in the field or major of his or her choosing.  In order to receive the scholarship money, the winner must actually attend a U.S. Department of Education accredited 2-year or 4-year college or university in the fall semester of 2012.  Funds will be paid by check in the name of both the student and the college or university designated by the student.

The receipt of the $2,000 scholarship is subject to the following conditions:

  • The winner must sign all required legal documents provided by Encharter, verifying and guaranteeing that the work submitted is an original, unpublished design authored by the winner.  Any design found to be, in any way, reproduced or copied from an existing work will immediately be disqualified and, if the scholarship has already been awarded, the winner will be required to return the funds.

 

  • The scholarship must be applied towards the winner's college or university tuition.

Encharter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this offer, program, or the Official Rules, in whole or in part, at any time.

Limitation of Liability:

Encharter is not responsible for any incorrect or inaccurate information, technical error, or human error which may occur in the processing of entries and submissions.  Encharter assumes no responsibility for any error, omission, interruption, deletion, defect or alteration of entries.  Furthermore, all contest participants, regardless of whether a video is submitted as an entry, agree to indemnify Encharter and its affiliates against, hold them harmless from, and defend them against, any and all claims, suits, actions, damages, losses and expenses (including, without limitation, reasonable attorney’s fees) arising from the participant’s participation in this scholarship contest.

Selection of Winner:

Timeline:

Entries must be submitted by April 27, 2012.  Entries received after April 27, 2012 will be disqualified.  Encharter will select, in its sole discretion, submitted videos to post on its Facebook page.  Encharter reserves the right to exclude from this contest any video submitted that does adhere to the guidelines in these Official Rules.  The winning video will be selected by receiving the most votes from on-line voting conducted from 9:00 a.m. on April 30, 2012 through 3:00 p.m. on May 4, 2012.  Encharter will have the responsibility for tallying the votes.  Comments posted will not be counted as votes.  Voters are limited to one voting entry. Encharter Insurance reserves the right to discount votes from voters deemed to be attempting to stuff the ballot. The winner will be announced at 4 p.m. on May 8, 2012 and Encharter will notify the winner by e-mail.  If Encharter does not receive a reply from the winner by email within ten (10) days from the date the notice is sent, then the scholarship will be forfeited and the video receiving the second highest number of on-line votes will be the alternate winner.  

Before receiving the scholarship money, the winner may be required to complete and return an affidavit of eligibility, a publicity/liability release, and a confirmation of originality and assignment of all rights to the winning design, within two (2) weeks of responding to the notification.

Terms & Conditions:

By submitting an entry, you agree to be bound by these Official Rules and the decisions of Encharter, which shall be final.  All applicable federal, provincial, state, and local laws and regulations apply.

Your submission of an entry under this program, whether or not you are the winner, constitutes your consent to Encharter’s use of your name, city and state of residence, and your video entry, for advertising, publicity, and promotional purposes in any media, online or offline, without further permission, consent, payment or other consideration.  Further, your submission of a video entry, whether or not you are the winner, constitutes your agreement, without any additional payment or consideration, that Encharter shall own all right, title, and interest (including without limitation patent rights, copyrights, and all other intellectual property rights) to your submission, and you thereby assign to Encharter all right, title, and interest in and to your submission, including without limitation the right to reproduce, distribute, sublicense, perform, and display the work and to create and use derivative works therefrom in any medium throughout the world.  The term “derivative works” as used herein has the same meaning as used in the Copyright Act of theUnited States.  You agree to complete and execute all documents reasonably requested by Encharter to confirm and effectuate the provisions of this paragraph.

By submitting a video entry under this program, you represent and warrant to Encharter and its affiliates that the work you submit is an original, unpublished design authored by you and that no other person or entity has any legal rights to the work.  You also agree to indemnify Encharter and its affiliates against, hold them harmless from, and defend them against, any and all claims, suits, actions, damages, and expenses (including, without limitation, reasonable attorney’s fees) arising from any third-party claim against any of them that a third party has any legal rights to the work that you submit.
